DOLE issues pay guidelines for December holidays

The Department of Labor and Employment has announced compensation rules for private sector workers during December holidays, including the Feast of the Immaculate Concepcion, Christmas Eve, Christmas Day, Rizal Day, and New Year’s Eve.

The labor department issued an advisory outlining payment requirements for employers during the holiday period.

Special non-working holidays

For December 8, 24, and 31, designated as special non-working holidays, the following compensation rules apply:

Employees who do not report for duty will not receive pay unless their company policy, established practice, or collective bargaining agreement provides otherwise.

Workers who report during these special holidays receive 130% of their basic wage for the first eight hours. Those working beyond eight hours earn an additional 30% of their hourly rate for overtime.

When a special holiday coincides with a worker’s scheduled rest day, employees receive 150% of their basic wage for the first eight hours, with overtime compensated at an additional 30% of the enhanced hourly rate.

Regular holidays

On the other hand, December 25 and 30, classified as regular holidays, follow different compensation standards:

Employees receive full pay even without working, provided they reported for duty or were on paid leave the day immediately before the holiday. This requirement also applies when the preceding day is a non-working day or scheduled rest day.

Workers who report during regular holidays earn 200% of their basic daily wage for the first eight hours, with overtime hours compensated at an additional 30% of the enhanced hourly rate.

When regular holidays fall on rest days, employees receive 260% of their basic wage for the first eight hours, with overtime paid at an additional 30% of this rate.
