OLONGAPO CITY– Dinismis ng Sandiganbayan ang kasong graft na isinampa sa dating Olongapo City mayor at ngayo’y Subic Bay Metropolitan Authority (SBMA) na si Chairman Rolen C. Paulino at ng 15 iba pa may ilang taon na ang nakakaraan.

Ang pag-absuwelto ay nakasaad sa resolusyong may petsang Oktubre 24, 2022 na inilabas ni Associate Justice Maria Theresa Dolores C. Mendoza-Arcega na kinatigan naman ni Chairperson Rafael R. Lagos at Associate Justice Maryann E. Corpus-Mañalac.

Nakasaad sa anti-graft court’s Fifth Division resolution na isinisi sa prosecution ang umano “delayed filing of the case” na ayon kay Paulino ay labag sa kanyang “right to speedy disposition of cases”.

“Certainly, the length of delay or more than four years in completing the present information and the failure of the prosecution to present justifiable reasons of such delay, this court rules that all of herein accused’s right to speedy disposition of cases had been violated,” saad sa desisyon ng korte.

Si Paulino ay sinampahan ng kasong paglabag sa Section 3(e) of the Anti-Graft and Corrupt Practices Act dahilan sa umano’y iregularidad sa lease agreement sa Olongapo City Civic Center sa SM Prime Holdings, Inc. (SMPHI) noong 2014 hanggang 2015.

Kasama sa mga sinampahan ng kaso sina Vice Mayor Aquilino Cortez Jr. at mga Konsehal na sina Elena Calma Dabu, Benjamin Cajudo II, Eduardo Guerrero, Noel Atienza, Alruela Bundang-Ortiz, Edna Elane, Emerito Bacay, Randy Sionzon, at Egmidio Gonzales Jr.

Kabilang na din rito ang iba pang opisyales ng siyudad na pawang mga miyembro ng Special Bids and Awards Committee (SBAC) noon na sina City Planning and Development Officer Tony-Kar Balde III, Cristiflor Buduhan ng Office of the City Accountant, Anna Sison ng Office of the City Legal Officer, Mamerto Malabute, Office of the City Administrator, Department Head II Joy Cahilig, Office of the City Budget Officer.
